These Terms of Use contain the complete terms and conditions that apply to an individual’s or entity’s participation in the program/use of the PMI Site (defined below), its contents and services as provided on the said web-portal.
In these Terms of Use, “we”, “us”, “our” or “PMI” means PMI www.propertymanagementindia.in (including its successors and assigns), and “you” means the applicant or any user of the PMI Site and the Services (defined below). “PMI Site” or “Website” means the www.propertymanagementindia.in website, owned by individual proprietor, Bangalore and operated in Bangalore and other cities by PMI . “Your site” means your website where you will link to the PMI Site (and which you will identify in your Program application).
Through the PMI Site, PMI provides a platform with a host of services, including but not limited to rent house brokering assistance , Shifting solutions by logistics service providers; facilitation of electronic payments between payer and beneficiary thereof; data collection and payment management to enable addition of e-convenience fees,seamless payment and information management;and
other ancillary services to facilitate the above; Hereinafter collectively referred to as the “Services” .
Use of the Website and the Services is offered to you conditional upon your irrevocable consent and acceptance of all the terms, conditions and notices contained in these Terms of Use, along with any amendments made by PMI, at its sole discretion, and notified on the Website from time to time, including by way of imposing additional charges for access to or use of any Service(s).
Please read the Terms of Use carefully before accessing or using the Website. By accessing or using any part of the Website and/or the Services, you agree to become bound by the Terms of Use. If you do not agree to all or any of the Terms of Use, you may not access the Website or use any Services. If these terms and conditions are considered an offer, acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 18 years old and otherwise capable of contracting under Indian laws.
You acknowledge and agree that we have the right to revise and amend any of the Terms of Use from time to time to reflect inter alia, changes in market conditions affecting business, changes in technology, changes in relevant laws and regulatory requirements and changes in our system’s capabilities. We shall not be under the obligation to separately or personally notify you, whether as a registered user or not, of any changes made to the Terms of Use and shall not be obligated to make available the revised Terms of Use on the Website prior to them becoming effective. Your use of the Website and the Services is subject to the most current version of the Terms of Use made available on the Website at the time of such use. You are requested to regularly visit the Website to view the most current Terms of Use. Your continued use of the Website subsequent to the modified Terms of Use will constitute your acceptance of those changes.
By (i) using the Website or any facility or Services provided through the Website in any way; or (ii) browsing the Website; you agree that you have read, understood and accepted these Terms of Use as well as the Website’s Privacy Policy available on the Website.
PMI hereby grants you a non-exclusive, limited privilege to access and use this Website and the Services offered on the Website, subject to compliance with these Terms of Use.
You agree not to access (or attempt to access) the Website, its content, the Services or any materials, documents and information, etc. uploaded by you and/or by the agents, banks and/or any third parties on the Website (collectively, the “Materials” ), by any means other than through the interface that is provided by PMI. You shall not use any deep-link, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or its content, or in any way reproduce or circumvent the navigational structure or presentation of the Website, the Materials or any content, or obtain or attempt to obtain any Materials through any means not specifically made available through the Website.
You must not misuse the Website by introducing Viruses, Trojans, Worms, Logic Bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial of service attack or a distributed denial of service attack. You must not attack the Website by any other means recognized as an attack vector.
These Terms of Use are binding on you, your respective successors and permitted assigns. You may not transfer, assign, charge or otherwise dispose of any of your rights or obligations, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of any of our rights or obligations at any time. We are entitled to involve third parties to satisfy our contractual obligations without being required to notify you.
You agree to use the Services, the Website, and the Materials only for purposes that are permitted by: (a) the Terms of Use; and (b) any applicable law, regulation or generally accepted practices or guidelines in India.
Access to the Website is permitted on a temporary basis, and we reserve the right to restrict or suspend access to the Website or close it indefinitely, at our sole discretion. You are responsible for making all arrangements necessary for you to have access to the Website and for ensuring that all persons who access the Website through your internet connection are aware of these Terms of Use, and that they comply with them.
You acknowledge and accept that computer and telecommunications systems are not fault free and may from time to time require periods of downtime for the purposes of repair, maintenance and upgrading or otherwise, during which periods, the Website and the Services will not be available. Accordingly, we do not guarantee uninterrupted availability of the Website and the Services, but we will make reasonable efforts to minimize any periods during which the Website and the Services are not available.
A system outage has occurred if no information can be submitted due to an unforeseeable disruption in a system. In such a case, our Services will be temporarily suspended.
In addition, we shall not be liable or responsible for
faulty operation of computers during the registration process or during accessing the Website or during the transmission of any data and/or for incorrect or overly slow transmission of data by the internet provider and/or any damage that occurs due to information submitted by you not being received by PMI or not being received promptly or not being considered, as a consequence of technical faults with our software or hardware (whether or not they are within or outside of our control);any loss or damage due to viruses or other malicious software that may infect your computer equipment, software, data or other property caused by you accessing, using or downloading from the Website, or from transmissions via emails or attachments received from Us; any failure to perform, or delay in performance of, any of our obligations or Services that is caused by events outside our reasonable control; Hereinafter collectively referred to as “Force Majeure Event(s)” “Services” .
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following (i) strikes, lock-outs or other industrial action; (ii) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; (iii) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; (iii) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; (iv) impossibility of the use of public or private telecommunications networks; and (v) the acts, decrees, legislation, regulations or restrictions of any government, as may be applicable.
We will use our reasonable endeavors to bring the Force Majeure Event(s) to a close or to find a solution by which our obligations may be performed despite the Force Majeure Event(s), however we shall not be responsible or liable for any losses or damages if we are unable to do so.
You acknowledge and agree that any use of the Website and the Services will be at your sole risk.
If you post or upload any materials on the Website, you hereby undertake to ensure that such materials are strictly of nature and context as referred to by the Website, and are not in violation of any applicable laws. Further, You undertake not to:
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
Defame, abuse, harass, threaten or otherwise violate the legal rights of others;
Publish, post, upload or distribute files that contain viruses, corrupted files, or any other malicious software or programs that may damage the operation of the Website or another’s computer;

Use the Website or Services or any Materials for any purpose that is fraudulent, unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of PMI or other third parties;
Publish, post, upload or distribute any Materials or information that is, or contains bookmarks, tags or keywords which are, illegal, inappropriate, profane, obscene, offensive, (including but not limited to material that is sexually explicit or which promotes racism, bigotry, hatred or physical harm), abusive, harassing, misleading, indecent, defamatory, disparaging, or menacing, or is otherwise injurious to third parties, or objectionable in any manner whatsoever;
Publish, post, upload or distribute any Materials or information which consists of or contains political campaigning, commercial solicitation, chain letters, surveys, contests, pyramid schemes, mass mailings or any “spam”; or which may cause annoyance, inconvenience or needless anxiety to us and/or to any third parties;
Download any file posted by another user of a Service that you know, or reasonably should know, cannot be legally distributed in such manner;
Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
Violate any code of conduct or other guidelines, which may be applicable for or to any particular Service;
Violate any applicable laws or regulations for the time being in force within or outside India;
Decompose, reverse engineer, modify copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Website.
In order to access the Website and to obtain the benefit of the Services, you will have to register and create your user account/profile by providing accurate and complete information to us.We are not responsible for verifying the accuracy of any such information provided by you. However, we reserve the right to refuse/reject your request for creation of user account/profile on the Website, at our sole discretion, if the data or information submitted by you appears to be erroneous, incomplete, incorrect or fraudulent.
During the registration process, you must select a user name which is not offensive, does not offend common decency and does not infringe upon the rights of any third parties. User accounts / profiles created during registration are non-transferable and may be used by you only. You are solely responsible for your profile and any activity on it, and must keep your password secure at all times. As soon as you become aware of any unauthorized use of your profile or password, you must notify us at support@propertymanagementindia.in immediately. We will not be liable, under any circumstances, for any losses caused by any unauthorized use of your profile/user account or password.
We reserve the right to temporarily or permanently disable your account when, in our reasonable opinion, you have breached any of these Terms of Use. You may also be disqualified or your user account / profile may be disabled if a fraudulent credit or debit card is used or the bank or other credit institution reverses the credit or debit card.
If you breach any of these Terms of Use, we reserve the right to block access to your user account / profile and/or to procure that any outstanding deliverables from our end are withheld, and any outstanding transactions are cancelled/suspended immediately.
Some of the Services may require you to download software or content and/or agree to additional terms and conditions. Unless otherwise provided, those additional terms are hereby deemed to be incorporated into these Terms of Use.

Facilities and data transfer
The Website and the processes, and their selection and arrangement, including but not limited to all text, graphics, user interfaces, visual interfaces, sounds and music (if any), artwork and computer code (collectively, the “Content”) on the Website is owned by sole proprietor and licensed to PMI, and the design, structure, selection, coordination, expression, look and feel and arrangement of such Content is protected by copyright, patent and trademark laws, and various other intellectual property rights.
All facilities used to store and process a transaction and user data will adhere to reasonable security standards no less protective than the security standards at facilities where PMI processes and stores its own information of a similar type. PMI has implemented industry standard systems and procedures to ensure the security and confidentiality of a transaction and related user data, protect against anticipated threats or hazards to the security or integrity of a transaction and related user data, and protect against unauthorized access to or use any user data. You agree and understand that PMI is trying to facilitate seamless information, payment and document processing. By using the Website you acknowledge and agree that PMI is not responsible for any failure of the Website to store, transfer or delete data or for the corruption or loss of any data, information or content contained therein. You further acknowledge and agree that you have the permission, and that you have granted PMI your permission as well as the non-exclusive right to store and transfer your data, as part of the Services rendered. We do not claim any ownership, intellectual property rights or other rights whatsoever outside the scope of what is necessary to transfer your uploaded data as part of the Services.
You acknowledge and agree that you are solely responsible for your own data/Materials submitted to, transmitted through, or linked from the Website and the consequences of submitting, transmitting, linking or publishing it. More specifically, you are solely responsible for all data/Materials that you upload, email or otherwise make available through the Website. In connection with such data/Materials posted on, transmitted through, or linked from the Website by you, you acknowledge, represent, and warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to upload, transmit, link or publish such data/Materials on the Website (including without limitation all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all such data/Materials, as may be applicable) and that you hereby grant PMI, express, irrevocable, world-wide and royalty-free license and authorization to use such data/Materials in the manner contemplated by the Service, the Website and these Terms of use; and (ii) you have the written consent, release, and/or permission of each and every identifiable individual/ entity in the data/Materials to use the name or likeness of each and every such identifiable individual/ entity to enable the use of such data/Materials in the manner contemplated by the Service, the Website and these Terms of Use, and (iii) any use by PMI of the data/Materials uploaded, transmitted, linked or published by you on the Website, shall not constitute infringement of any third party’s rights.

Intellectual Property
The Website and the processes, and their selection and arrangement, including but not limited to all text, graphics, user interfaces, visual interfaces, sounds and music (if any), artwork and computer code (collectively, the “Content”) on the Website is owned by sole proprietor and licensed to PMI, and the design, structure, selection, coordination, expression, look and feel and arrangement of such Content is protected by copyright, patent and trademark laws, and various other intellectual property rights.
The trademarks, logos and service marks displayed on the Website (“Marks”) are the property of sole proprietor and licensed to PMI, or the property of their vendors or respective third parties, as the case may be. You are not permitted to use the Marks without the prior written consent of PMI, the vendor or the third party, as the case may be, or use, exploit or otherwise try to have any indirect or direct right or ownership on the Marks.
Except as expressly provided herein, you acknowledge and agree that you shall not copy, republish, post, display, translate, transmit, reproduce or distribute any Content through any medium, without obtaining the necessary prior written consents and authorization from PMI or thirty party owners of such Content, as the case may be.
These Terms of Use do not transfer from PMI to you, any PMI or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with PMI. PMI logo, and all other trademarks, service marks, graphics and logos used in connection with PMI or the Website are trademarks or registered trademarks of PMI or PMI licensors. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any PMI or third-party trademarks.

Copyrights and other infringement
In the event of you indulging in infringement of the copyrights or other intellectual property rights of PMI, PMI may, in its discretion, terminate or deny access to and use of the Website. In the case of such termination, PMI will have no obligation to provide a refund of any amounts previously paid to PMI.
PMI reserves the right to investigate and take appropriate action against anyone who, in our opinion, is in breach of these Terms and Conditions, and in particular, provides any text, files, images, photographs, video, sounds, musical works, works of authorship or any other materials on the Website which is defamatory, offensive, discriminatory, infringes any intellectual property rights of any other person or is in any way illegal. Such action includes, but is not limited to, reporting such prohibited content and your details to the appropriate law enforcement agencies, removing such prohibited content or any content that PMI considers, in their absolute discretion, may be prohibited content from the Website, terminating your registration and terminating access to the Website and the Services. Any material you upload to the Website will be considered non-confidential and PMI shall have the unlimited and non-exclusive right and license to use, copy, distribute and disclose to third parties any such material for any purpose.
Sole proprietor is the owner of all intellectual property rights on the Website and the material published on it, which rights have been licensed exclusively to PMI. Those works are protected by copyright laws and treaties around the world and all rights relating to the same are reserved. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Privacy and Information Disclosure: Your use of the website or the service provided by PMI thereunder, signifies acknowledgement of, and agreement to our ‘Privacy Policy’, as available on the Website. Without prejudice to the above, you agree that in the event you do possess or may possess any legal or equitable rights or remedies against PMI in the context hereof, you agree to waive, and hereby do waive any such right by agreeing to these Terms of Use.

Limitation of liability
In no event will PMI, its officers, employees, agents, associates and successors, or any of its sponsors or licensors, be liable with respect to any subject matter of these Terms of Use under any contract or torts, or on account of negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data.
The liability of PMI towards any user of the website arising under or pursuant to these Terms of Use or on account of any other reason in connection with the use of the Website and/or the Services, shall at all times be limited to the amount of consideration or fees received by PMI from such user for the Services.
We are not responsible for indirect or consequential losses which happen as a side effect of the main loss or damage including, without limitation:
Loss of income or revenue;
Loss of business;
Loss of profits or contracts;
Loss of anticipated savings;
Loss of data,
Loss of goodwill or injury to reputation;
Loss of emotional well-being, including, without limitation, any embarrassment caused;
Losses suffered by third parties; or
Waste of management or office time; howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
General Representations and Warranties: You represent, warrant and confirm that (i) your use of the Website will be in strict accordance with the PMI Privacy Policy, these Terms of Use and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from India or the country in which you reside or any other laws, rules and regulations); (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party; and (iii) you are not below 18 years of age.
Refund Policy: All payments made by you to the beneficiary are remitted near ‘Real Time’ to the specified beneficiary. PMI shall be unable to refund to you, either in part or full, any such amounts paid by you. Any such refunds may be claimed by you from the beneficiary, and PMI shall not be liable or responsible for the same.

Indemnification
You agree to indemnify and hold harmless PMI, its officers, agents, employees, its subsidiaries, affiliates, contractors, sponsors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys’ fees, of every kind and nature, arising directly or indirectly on account of or pursuant to your use of the Website or the Services, including but not limited to your violation of these Terms of Use.
In no event shall PMI be liable to you or to any third party for any losses or damages arising out of your use of the Website or the Services, whether based on warranty, contract, tort (including negligence) or otherwise.
We will not accept any liability for any loss or damage (actual and consequential) resulting from or in connection with the use of the Website and/or the inability to use it or for any loss or damage (actual and consequential) resulting from any delay or failure in the performance of the Services on account of any third party or person or due to any technical or technological failure or any other circumstances beyond the control of PMI.
Governing Law: The rights and obligations arising out of or in connection with these Terms of Use shall be construed, governed, interpreted and enforced in accordance with the laws of India.
Jurisdiction: Subject to the arbitration provisions below, and notwithstanding where the Website has been accessed from, you agree and acknowledge that the courts in Bangalore shall have the sole and exclusive jurisdiction and be the sole and exclusive venue of any action with respect to these Terms of Use or with respect to any other matter arising as a result of or in connection with the Website, the Content, the Materials and/or the Services. You expressly waive any express or implied objection to the same.
Arbitration: All differences or disputes between you and PMI relating to or arising out of or pertaining to these Terms of Use, which cannot be resolved amicably within 30 (thirty) days of the dispute having arisen, shall be referred to arbitration in accordance with the provisions of Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed by PMI. The venue for the arbitration shall be Bangalore.The arbitrator’s award shall be final and binding upon the parties. The arbitration proceedings shall be conducted in the English language.
Severability:These Terms of Use supersede any and all prior oral and written quotations, communications, agreements and understandings between you and us. These Terms of Use shall apply in preference to and supersede any and all other terms or conditions of any use of the website and the Services by you. In the event that these Terms of Use shall become partly invalid, the same will not affect the validity of the remainder terms, and both you and we shall continue to remain bound by these.
Waiver: If PMI is unable at any time, to insist upon strict performance of any of your obligations or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations. A waiver by us of any default will not constitute a waiver of any subsequent default. No waiver of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

You agree that you are solely responsible to PMI and to any third party for any breach of your obligations under the Terms of Use and for the consequences of any such breach (including any loss or damage which PMI or its affiliates or any third party may suffer).
You agree and acknowledge that PMI is merely facilitating the transactions inter se between the users on the Website by providing the Services and shall in no manner be deemed to be liable or responsible for any such transactions or be construed as the agents of the users or the banks or any other parties that may be involved in the transactions.
You agree that PMI may, at any time, modify or discontinue all or part of the Website and/or the Services, change, modify or waive any applicable fees required to use the Website or avail any of the Services, or offer any other opportunities/services to some or all of the users of the Website.

SUBSCRIPTION PLANS
i. Property Management India offers a combination of Services which the User may subscribe to, subject to the need of the User, upon payment of applicable fees.
ii. The subscription fee paid by the User is non-refundable except when the User selects the Moneyback Plan as detailed on the Site.Users are advised to go through refund policies for the same.
iii. Property Management India reserves the right to revise or upgarde the fee of any subscription plan without or with notice to the User at any time prior to, at the time of, during the tenor or post subscription of the plan by the User. Property Management India shall intimate the User of such revised fees and the User undertakes to pay to Property Management India the difference in the amount after such revision.

RIGHTS OF PROPERTY MANAGEMENT INDIA
i. Property Management India, at all times, reserves the right, to reject or disable an Account in the event of the User’s violation of any Applicable Law or anything done by the User in contravention of this Agreement and including but not limited for any other reason in relation to the safe and secure operation of the Site.
ii. Subject to Applicable Law, PropertyManagementIndia has an internal infrastructure in order to conduct a background check and verification of the User Information and the Account in order to ensure that the Brokers are not registering themselves on the Site. In the event, a User is detected as a Broker, PropertyManagementIndia has the right to reject or disable such Account without cause.
iii. PropertyManagementIndia has the right to modify, suspend or terminate all or any part of the Services including its features, structure, fees and layout, and/or suspend or deactivate, whether temporarily or permanently, the User Account and/or User’s access to the Site, at any time, without any prior notice to the User.
iv. PropertyManagementIndia shall endeavor to provide the User an advance notice, without any obligation to do so, of any suspension or deactivation of the Site for the purposes of repair, any inspection or testing by a Government Authority, or for maintenance, upgradation, testing or any other reason as PropertyManagementIndia may deem fit. PropertyManagementIndia shall use its best efforts to rectify any disruption of or rectify an error on the Site and restore regular operations of the Site.
v. PropertyManagementIndia has the right to issue notifications, confirmations and other communications to the User, on the Site, through e-mail, text message or any other form as may be agreed to by the User and/or send promotional or other relevant information in relation to the Services to the User. PropertyManagementIndia may also send users occasional e-mail bulletins unless the Users have opted not to receive these e-mails. PropertyManagementIndia does not take any responsibility of the validity of any of these offers. The Users shall have the right to unsubscribe from receiving any such notifications or promotional information at any time by sending a mail to support@propertymanagementindia.in.

EUROPEAN UNION DATA PROTECTION RIGHTS
i. Subject to Applicable Law and in accordance with the European Union General Data Protection Regulations (EU GDPR), PropertyManagementIndia acknowledges and undertakes to comply on a best effort basis with the rights available to its Users of European nationality/ EU residents set out below:
(a) the right to know the purposes for which the User Information shall be collected and used;
(b) the right to access information that personally identifies the User;
(c) the right to rectify incorrect information;
(d) the right to delete or remove information after discontinuation of the Services;
(e) the right to data portability;
(f) the right to restrict data or information from being processed; and
(g) the right to opt out of providing or sharing information with PropertyManagementIndia.
ii. The Users of PropertyManagementIndia to whom the EU GDPR applies, understand and acknowledge that these rights shall at all times be subject to Applicable Law and are not an exhaustive list of the rights available pursuant to the EU GDPR. The relevant Users shall exercise any of these rights by raising a personal and direct request with PropertyManagementIndia on support@propertymanagementindia.in.

UNAUTHORIZED ACCESS
i. The User shall be liable for all acts conducted through the User’s Account and shall be responsible for the safekeeping of the details and password of the Account.
ii. Subject to Applicable Law, the User is responsible for notifying PropertyManagementIndia immediately upon becoming aware of any unauthorized access into or misuse of the Account causing a breach of security as per the Terms and Conditions and Privacy Policy of PropertyManagementIndia.
iii. PropertyManagementIndia shall extend support by ensuring immediate termination or suspension of such Account and shall take such other appropriate safety measures as it may deem necessary. Further, PropertyManagementIndia shall not be held liable for any unauthorized access into the Account and/or any loss or damage caused to the User by such unauthorized access or loss or damage caused as a consequence of the delay or failure of the User in informing PropertyManagementIndia about such unauthorized access.
iv. In order to better protect the secrecy of the User Information, the User is encouraged to change the password of the Account from time to time.
